Golden Visa

The Golden Visa grants a number of benefits to the applicant, such as the right to live and work in the country or to travel in the rest of the free movement territory (Schengen area). It is acquired by purchasing one or more properties totaling 500,000 euros that are free of encumbrances.

What is the Golden Visa?

The Golden Visa programme is a special residency option aimed exclusively at non-EU nationals wishing to move to Spain and make an investment of at least 500,000 euros. Compared to traditional processes for obtaining residence permits, the Golden Visa offers simplicity and speed, making it increasingly popular with non-EU investors.

Spain has become a leading destination for the Golden Visa, with a high number of residence permits granted compared to other European countries. Demand for this type of visa continues to grow, especially after Ireland and Portugal withdrew their similar programmes. Who can benefit from the Golden Visa?

The Golden Visa is aimed at non-EU citizens who wish to invest in Spain in order to obtain residency.

China and Russia are the countries where this residence permit is most popular, but there are also many beneficiaries from Lebanon, Venezuela and other Latin American countries.

The main reason is to be able to have a property in Spain as a residence or investment, in addition to obtaining a visa that simplifies the procedures compared to other visas.

Corresponding law

It is essential to highlight the specific regulation that applies to the residence permit for investors in this situation. This is because we are referring to the Entrepreneur Law 14/2003, and not to the general Spanish Aliens Law.

This difference will be crucial for your legal situation, especially with regard to the application and subsequent renewals.

Unlike other visas under the general immigration law, the Golden Visa application can be made immediately from Spain.

In addition, the Golden Visa grants you a first residence and work permit in Spain for a period of two years, instead of just one.

Another important distinction with respect to other permits issued under the same Entrepreneurs Law is that, after five years, a second renewal of the Golden Visa can be made, which will eventually allow you to apply for permanent residence.

How long can a person with an investor visa stay in Spain?

Once the Golden Visa has been granted, the investor has a period of two years to reside legally in Spain. Subsequently, they may renew this permit for a further five years, provided they can prove that they still have the initial investment, whether in real estate, shares or public debt.

In addition, it is a requirement to have travelled at least once to Spain during the year. If the investor is interested in obtaining Spanish citizenship through investment, he/she should bear in mind that after ten years of legal residence, he/she will be able to apply for Spanish nationality.
